Terms
These agreements and provisions ("Terms") refer to any purchase of any aquatic plants and/or relevant goods ("items") by ("Utopia Aquatic LLC") ("Utopia Aquatic") ("UA") ("We") ("Us") on the online invoice supplied to you. Your engagements with UA justifies your acceptance of and acknowledgement to such agreements and provisions.
i. Additional Documents; Edits. These Terms cannot be modified, added to, or amended by other document(s) without additionally being accepted by you and Utopia Aquatic. However, we hold the right to edit the Terms without your notification. You are accountable for reviewing them.
ii. Terms of Payment; Orders.
Payment must be received by Utopia Aquatic in full before items are dispatched. We accept Google Checkout, Amazon Payments, and PayPal. We also accept VISA, MasterCard, American Express, and Discover. These are processed via PayPal--though you do not need an account with PayPal to submit a payment. If a major credit card is used with Google Checkout, PayPal or Amazon Payments, it will show 'Utopia Aquatic' on your statement. We do not accept money orders, personal checks, or cash;
Utopia Aquatic reserves the right to cancel any order. Unless you and Utopia Aquatic has agreed to a particular special/discount, standard prices shall apply.
iii. Shipping; Taxes; Ownership.
Domestic items are mailed via USPS Priority Mail. This service averages 2-3 days in travel time to reach destination. We also offer USPS Express Mail. International items are primarily mailed via USPS Express Mail International. This service averages 5 days in travel time to reach destination. There are no refunds on shipping;
You are required to pay taxes on items if you reside in the state of Florida;
Upon shipment, ownership of items is transferred to you from UA.
iv. Warranties; Guarantees; Returns.
There is no expressed warranty beyond our live guarantee;
UA guarantees that you will receive healthy and truly-named tropical water lilies. If your package has any perished plant(s), please contact us immediately. Do not toss the plant(s) as we may require photo verification. Upon confirmation of the loss, we will reship the perished plant(s) or provide a refund for the cost of the plant(s). Utopia Aquatic advises notifying the carrier ahead of time or planning accordingly as items that are left in extreme heat or cold could perish. If no one will be able to accept the package, please provide an alternative address such as a work address;
There are no returns or exchanges.
v. Support. Utopia Aquatic does provide support on items and will advise on tropical water lilies upon request.
vi. Consent for Commercial Use; No Harmful Use of the UA Web Sites.
The Utopia Aquatic web sites are for your personal use only. You will not use the UA web sites for commercial purposes without first requesting and being granted such rights. You can make such a request on our Contact page;
You will not engage in any harmful acts against the UA web sites or those web sites accessible through Utopia Aquatic.
vii. Privacy Policy.
Utopia Aquatic respects the right to privacy of every individual who visits our website. UA does accept your information when orders for items are placed or when an inquiry is made. We also collect anonymous traffic data. Both your personal and customer information is kept confidential. Your financial information is never revealed to Utopia Aquatic. Your information is used solely to process your order for items and/or better assist you. It is never sold, shared with anyone, or given away.
